1. 協議的法律性質

Legal Nature of the Agreement

通過報名並繳費，您即表示理解、接受並同意遵守本《考生協議》及 HKCDAA 不時修訂的考試政策與規則（以下簡稱“政策”）。若未遵守相關規定，HKCDAA 有權取消您的考試成績，並暫停或終止您的考生資格。

By registering and paying the examination fee, you acknowledge, understand, and agree to comply with this Candidate Agreement and the examination policies and rules as amended by HKCDAA from time to time. Failure to comply may result in cancellation of your examination results and suspension or termination of your candidacy.

2. 報名與考試費用

Registration and Examination Fees

本考試費用由考試獨家運營機構 Uweb Limited 收取。若 HKCDAA 或 Uweb 未收到您本人或第三方支付的全部考試費用，您將無權參加考試或獲取相關學習資料。無論費用由您本人還是第三方支付，您均受本協議約束。

所有考試費用在繳納後，除因 HKCDAA 因不可抗力或其他原因取消考試外，概不退還，且考試名額不得轉讓。

The examination fees are collected by Uweb Limited as the exclusive operating institution. If HKCDAA or Uweb does not receive the full payment from you or a third party, you will not be permitted to sit for the examination or access study materials. Regardless of who makes the payment, you remain bound by this Agreement.

All fees paid are strictly non-refundable and non-transferable, except in cases where the examination is cancelled by HKCDAA due to force majeure or other valid reasons.

3. 不當行為

Misconduct

任何損害或試圖損害考試聲譽、完整性、有效性或安全性的行為，均構成不當行為，包括但不限於舞弊、作弊、洩露試題、冒名頂替、協助他人違規等。

Any act that damages or attempts to damage the reputation, integrity, validity, or security of the examination constitutes misconduct. This includes, but is not limited to, cheating, disclosing examination content, impersonation, or assisting others in misconduct.

4. 考生承諾

Candidate’s Commitment

在考場或考試系統中，您須確認承諾遵守考試紀律與保密義務，不得以任何形式洩露考試內容。

At the test center or within the examination system, you must confirm your commitment to abide by examination discipline and confidentiality obligations. Disclosure of examination content in any form is strictly prohibited.

5. 違規處理

Disciplinary Actions

HKCDAA 有權審查或調查涉嫌違規的事項，並可採取以下一項或多項措施：

• 作廢或暫緩公佈您的成績；

• 取消您考試資格；

• 追究法律責任。

HKCDAA reserves the right to review or investigate suspected misconduct and may take one or more of the following actions:

• Invalidate or withhold your examination results;

• Cancel your candidacy;

• Pursue legal action.

6. 考試材料所有權與使用

Ownership and Use of Study Materials

考生有權參加由 Uweb 組織的培訓。所有由 Uweb 提供的視頻課程、模擬試題及相關學習資料（以下簡稱“學習材料”）的知識產權均歸屬 Uweb 所有。

考生僅可將上述學習材料用於個人備考學習，不得以任何形式進行複製、傳播、銷售、公開或轉讓。考試內容屬機密信息，任何披露或傳播均被嚴格禁止。

Candidates are entitled to attend training organized by Uweb. All intellectual property rights in the video courses, mock exams, and related study materials (the “Study Materials”) provided by Uweb remain the property of Uweb.

Study Materials may be used solely for personal study and preparation. Reproduction, distribution, sale, disclosure, or transfer in any form is strictly prohibited. Examination content constitutes confidential information, and any disclosure is strictly prohibited.

7. 取消、退款與改期政策

Cancellation, Refund, and Rescheduling Policy

7.1 退款政策：考生所繳納的考試費用一律不予退還，除非因主辦方取消考試。

Refund Policy: Examination fees are strictly non-refundable, unless the examination is cancelled by the Organizer.

7.2 改期政策：

a) 考生如欲改期，須至少於原定考試日期的 55 個自然日（含第 55 日）之前提出申請。每位考生可享有一次免費改期的機會。

Candidates wishing to reschedule must submit a request at least 55 calendar days (inclusive) before the scheduled examination date. Each candidate is entitled to one free rescheduling.

b) 超過上述時限後，考試日期將不可再進行更改。

After this deadline, no changes to the examination date will be permitted.

c) 考生如需進行第二次或以上的改期（每次改期均須在原定考試日期的 55 個自然日（含第 55 日）之前提出），每次改期申請須繳付 1,000 港元的行政服務費。

Any subsequent rescheduling requests (each submitted at least 55 calendar days prior to the exam) will incur an administrative fee of HKD 1,000 per request.

d) 改期申請是否獲批，須視乎考場座位供應情況而定。

Approval of rescheduling requests is subject to seat availability.

7.3 缺考：若考生未在約定時間參加考試，將視為自動放棄考試名額，考試費用不予退還且不可改期。

Absence: Candidates who fail to attend the examination at the scheduled time will be deemed to have forfeited their seat. Examination fees are non-refundable and the seat is non-transferable.

8. 考試中斷與不可抗力

Examination Disruptions and Force Majeure

如因自然災害、疫情、場地故障、系統中斷等不可抗力因素導致考試受影響，HKCDAA 有權單方面調整考試日期。考生不得因此要求退費。

In the event that the examination is disrupted due to force majeure events such as natural disasters, pandemics, venue malfunctions, or system interruptions, HKCDAA reserves the right to unilaterally reschedule the examination. Candidates shall not be entitled to a refund in such circumstances.

9. 成績政策

Examination Results

考試結果以“通過/未通過”形式公佈。通過者將頒發《香港數字資產分析師資格認證考試合格證書》。

Examination results will be reported as “Pass/Fail.” Successful candidates will be awarded the Certificate of Completion of the Hong Kong Chartered Digital Asset Analyst Examination.

10. 隱私

Privacy

HKCDAA 將依照香港適用法律及《個人資料（私隱）條例》收集、使用和保護考生個人信息，僅用於考試與認證相關目的。

HKCDAA will collect, use, and protect candidates’ personal information in accordance with applicable Hong Kong laws, including the Personal Data (Privacy) Ordinance, and solely for purposes related to the examination and certification.

11. 考試調整權利

Rights to Amend Examination Policies

HKCDAA 保留對考試安排、考試內容、合格標準及相關政策進行調整的權利。

HKCDAA reserves the right to amend examination arrangements, content, passing standards, and related policies.

12. 管轄法律

Governing Law

本協議受香港特別行政區法律管轄，並依其解釋，任何爭議均應提交香港法院專屬管轄。

This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

Acceptance of Terms

本人已閱讀並完全理解本《考生協議》的所有條款，並同意遵守。如本人未能遵守本協議，HKCDAA 有權取消我的考試成績，並拒絕、暫停或終止我的考生資格。

I have read, understood, and agree to be bound by all terms of this Candidate Agreement. I understand that failure to comply may result in the cancellation of my examination results, refusal, suspension, or termination of my candidacy.
